Terms of Service
These Terms are the contract between you and Emrich Enterprises LLC (a Montana limited liability company), the operator of AIDiveForge. By using the site you agree to them. If you don't agree, please don't use the site.
- AIDiveForge is a free, editorial directory of AI tools. Information here is general guidance, not professional advice.
- Submit reviews, edits, and benchmarks at your own risk; you grant us a license to publish what you submit and keep accuracy your responsibility.
- Don't break laws, harass people, scrape outside our public dataset, or impersonate anyone.
- We can suspend access for any reason. Liability is capped at $100. Disputes go to Montana courts under Montana law.
1. Who we are and what you're agreeing to
"We," "us," and "AIDiveForge" mean Emrich Enterprises LLC (a Montana limited liability company). "You" means the person or organization using the website at aidiveforge.com, our newsletters, our public dataset, and anything else we offer (together, the "Service"). These Terms, along with the policies linked in §3, form a binding agreement.
If you're using the Service for a company or other organization, you confirm you have authority to bind that entity — and "you" includes that entity.
2. Eligibility
You must be at least 13 years old to use the Service (16 if you're in the EEA, UK, or Switzerland). If you're under the age of majority in your jurisdiction, your parent or guardian must agree to these Terms on your behalf.
3. Other policies that are part of this agreement
The following are incorporated by reference and apply alongside these Terms. Where they conflict with these Terms, these Terms control.
- Privacy Policy — what we collect and how we use it
- Cookie Policy — which cookies we set and why
- Acceptable Use Policy — what's not allowed on the Service
- Affiliate Disclosure — how we make money
- DMCA / Copyright Policy — copyright takedowns
- Email & Newsletter Policy — what we send and how to stop it
- Refund & Cancellation Policy — for any paid features (none today)
- Security & Vulnerability Disclosure — how to report a security issue safely
4. What the Service is
AIDiveForge is an editorial directory and comparison platform for AI tools. We list tools, compare them, publish performance benchmarks, run a weekly newsletter, and host community wiki sections, reviews, and benchmark submissions. Everything we publish is for informational purposes — it isn't professional, legal, financial, medical, or procurement advice. Always verify pricing and features on the vendor's own site before buying.
5. Accounts
Some features — submitting reviews, wiki edits, benchmarks, or workflow-pack proposals — require an account. When you register, give us accurate information and keep it up to date. You're responsible for everything that happens under your account.
If you suspect your account has been compromised, email security@aidiveforge.com right away. To close your account, email privacy@aidiveforge.com. Closure is subject to the retention rules in our Privacy Policy.
6. What you submit ("User Content")
"User Content" is anything you post on the Service — reviews, ratings, wiki edits, benchmark submissions, pack proposals, comments, screenshots, links, and so on.
6.1 You keep ownership
You own your User Content. We don't claim ownership.
6.2 You grant us a license
To run the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, copy, format, adapt, publish, translate, display, distribute, and create derivative works of your User Content. This license covers our website, our newsletters, and our publicly released dataset (which is separately MIT-licensed). It lasts as long as your User Content remains on the Service and survives termination of your account only as needed to keep the public record consistent. To the extent any moral rights apply, you waive them as the law allows.
6.3 You promise the following
- You wrote it or have permission to post it.
- It doesn't infringe anyone's copyright, trademark, privacy, publicity, or other right.
- It's accurate to the best of your knowledge and not defamatory or knowingly misleading.
- It follows applicable law and these Terms.
6.4 Moderation
We screen all User Content with an automated moderator (currently Anthropic's Claude API) and, when flagged, with human review. We may approve, reject, edit lightly for formatting or clarity, unpublish, or delete any User Content at our discretion. We aren't required to monitor the Service and don't promise to.
7. Acceptable use
The full list is in our Acceptable Use Policy. At a minimum: don't break the law, don't harass anyone, don't try to break into the Service, don't impersonate, and don't scrape the site outside our published dataset and API endpoints (and only within their published licenses and rate limits).
8. Intellectual property
8.1 What we own
The Service — software, design, copy, logos, the AIDiveForge brand, the curated compilation of listings — belongs to us or our licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal or internal business purposes.
8.2 Trademarks
"AIDiveForge" and our logos are trademarks of Emrich Enterprises LLC. Third-party tool names, logos, and trademarks shown on the Service belong to their respective owners and are used for editorial identification only (nominative fair use).
8.3 Public dataset
Our public dataset is released under the MIT License with its own README and CITATION files. Use of the dataset is governed by those terms in addition to these.
9. Third-party tools and links
The Service includes links to and references to third-party websites, apps, and services we don't control. We're not responsible for their content, pricing, terms, availability, or data practices. When you use a third-party service, you're dealing with that third party under their terms — not ours.
10. Editorial accuracy
We try hard to keep listings accurate, but pricing and features change constantly. Benchmarks come from public sources like Artificial Analysis and vendor documentation, refreshed periodically. Treat everything on the Service as a starting point — verify on the vendor's site before any purchasing decision.
11. Fees and monetization
The Service is free. We earn affiliate commissions when users sign up for tools through our links, as detailed in our Affiliate Disclosure. If we offer paid features later, they'll come with their own terms presented at checkout, and our Refund & Cancellation Policy will apply.
12. Copyright takedowns
If you believe content on the Service infringes your copyright, follow the procedure in our DMCA / Copyright Policy.
13. Disclaimers
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY BENCHMARK, PRICING, OR CAPABILITY INFORMATION IS ACCURATE OR CURRENT. SOME JURISDICTIONS DON'T ALLOW EXCLUSION OF CERTAIN WARRANTIES, SO PARTS OF THIS MAY NOT APPLY TO YOU.
14. Limitation of liability
TO THE MAXIMUM EXTENT ALLOWED BY LAW, IN NO EVENT WILL EMRICH ENTERPRISES LLC OR ITS OWNERS, OPERATORS, AGENTS, OR LICENSORS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION — ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE, WHETHER UNDER CONTRACT, TORT, STATUTE, OR OTHERWISE, EVEN IF WE'VE BEEN ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100.00). THESE LIMITS ARE AN ESSENTIAL PART OF THE BARGAIN.
15. Indemnification
You'll indemnify, defend, and hold harmless Emrich Enterprises LLC and its owners, operators, agents, and licensors from any claims, demands, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of (i) your User Content, (ii) your use of the Service, (iii) your breach of these Terms, or (iv) your violation of any law or third-party right. We may, at our expense, take over the defense of any matter you're indemnifying; if we do, you'll cooperate with us.
16. Suspension and termination
We may suspend, restrict, or terminate your access to all or part of the Service at any time, with or without cause and with or without notice. On termination, your license to use the Service ends. Sections 6.2 (for content already submitted), 6.3, 8, 13, 14, 15, 17, 18, and 20 survive.
17. Governing law
These Terms and any dispute about them or the Service are governed by the laws of the State of Montana, United States, without regard to its conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods doesn't apply.
18. Disputes; venue; time limit
Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Montana, and you and we each consent to personal jurisdiction there. Either party may seek injunctive relief in any competent court to stop infringement of its intellectual-property rights. Any claim related to the Service must be brought within one (1) year after the claim accrues, or be permanently barred.
19. Changes to these Terms
We may revise these Terms from time to time. The "Effective" date at the top reflects the date of the last substantive revision. For material changes, we'll give reasonable notice by posting the updated Terms here and, where appropriate, by direct email. Your continued use of the Service after the new Effective date constitutes acceptance.
20. Miscellaneous
Entire agreement. These Terms and the policies incorporated by reference are the entire agreement between you and us about the Service and supersede earlier understandings.
Severability. If any part of these Terms is unenforceable, that part is enforced to the maximum extent allowed and the rest stays in effect.
No waiver. Our not enforcing a provision once doesn't waive our right to enforce it later.
Assignment. You can't assign these Terms without our written consent. We can assign them without restriction.
No agency. No agency, partnership, joint venture, or employment relationship is created by these Terms.
Notices. Notices to us go to legal@aidiveforge.com. Notices to you may go by email to the address on your account or by posting on the Service.
Force majeure. Neither party is liable for delays caused by circumstances reasonably outside its control.
